Terms of Service.

These terms are an agreement between you and Next Imaginations, Chandigarh, India. By using this website, creating an account, or engaging us for services, you accept them. We’ve written them to be read. If anything is unclear, ask us before you agree.

01Our services

We provide IT and digital services including website development, cloud & AWS, cybersecurity & VAPT, AI solutions, digital marketing, IT infrastructure and data recovery. The specific scope, deliverables, timeline and price of any engagement are recorded in a written quote or proposal, which together with these terms forms the contract for that engagement.

02Quotes, pricing and GST

• Prices published on this website are indicative starting points, exclusive of GST at the applicable rate (currently 18%).
• Your final price is fixed in writing before work begins and does not change unless the scope changes, agreed by both sides in writing.
• Bundle and founding-client discounts apply as described on the pricing page at the time of quoting.

03Payments

• Smaller projects: an advance and a completion payment. Larger projects: milestone billing approved by you stage by stage.
• Invoices are payable within 7 days unless the quote says otherwise. Work may be paused on accounts more than 14 days overdue.
• Recurring services (marketing, AMC, managed cloud) are billed monthly in advance and may be cancelled with 30 days’ written notice.

04Cancellations and refunds

You may cancel a fixed-scope project at any time in writing. You pay for work completed and costs committed up to the cancellation date; any unused advance beyond that is refunded within 14 days. Completed and delivered work is non-refundable. Nothing in these terms limits your rights under the Consumer Protection Act, 2019.

05Your account

• You must be 18 or older, provide accurate details, and keep your credentials confidential. You are responsible for activity under your account.
• We recommend enabling two-step verification from your security settings.
• You may delete your account at any time from your dashboard; see the Privacy Policy for exactly what is erased and what accounting law requires us to retain in anonymised form.
• We may suspend accounts used for abuse, fraud, or attacks on the service, and will tell you why.

06Intellectual property

• On receipt of full payment, the deliverables created specifically for you become yours.
• We retain ownership of our pre-existing tools, libraries and know-how, which you receive a perpetual, non-exclusive licence to use within the deliverables.
• Third-party and open-source components remain under their own licences, which we identify on request.
• With your permission, we may reference the engagement in our portfolio, anonymously if you prefer.

07Confidentiality

Each side keeps the other’s non-public information confidential and uses it only for the engagement. This survives the end of the contract. We are happy to sign your NDA.

08Warranties and liability

• We warrant our services are performed with reasonable skill and care, and we fix defects in delivered work reported within 30 days of delivery at no charge.
• Except where Indian law does not permit limitation, each party’s total liability under an engagement is capped at the fees paid for that engagement, and neither party is liable for indirect or consequential loss.
• Nothing limits liability for fraud, wilful misconduct, or anything that cannot be limited by law.

09Acceptable use

You agree not to use this website or your account to attempt unauthorised access, disrupt the service, or violate any law. Security researchers acting in good faith are welcome to report vulnerabilities to us directly.

10Privacy

Personal data is handled as described in our Privacy Policy, which is part of these terms.

11Governing law and disputes

These terms are governed by the laws of India. We’ll always try to resolve disagreements by talking first. Failing that, disputes are subject to the exclusive jurisdiction of the courts at Chandigarh, India. Consumers retain any additional forum rights granted by the Consumer Protection Act, 2019.

12Changes and contact
